What you CAN do with Nana's Image and Sound Files:

  • for Personal, Educational, or non-profit use. This includes performances where patrons are charged a ticket fee.

  • for Commercial use under Creative Commons and Derivative Works licensing when:

    • used as part of a larger piece of work that you create.

      • example: you use parts of the artwork to create your own creative work; you use the audio as background in video content you create; you record your own tracks and attach them with the audio tracks to create your own digital output rendering of the song.

    • used as part of a service you deliver to clients, where that service does not include payment or representation of ownership, licensing, or copyright, for either you or your client.

      • example: you use the audio files to deliver paid services such as music lessons or content creation for your clients, where there is no additional fee charged to the client specifically for Nana's content and no implied or stated ownership, copyright, or control over the content by either you or your client.

What you CANNOT do with Nana's Image and Sound Files:
  • Resell or repackage the files in whole or in part to create a similar or competing product for sale. This includes using the images as part of a compilation, including clip-art collections. This also includes making shorter clips of the audio for sale, as well as including the files in collections for resale.
  • Give away, sell, or transfer any rights to the files in whole or in part, without additional work which would be covered under Creative Commons or Derivative Works.

  • Use the image files as is for Print-on-Demand products that you resell. This includes simple edits such as adding a border or trim around the image. To be able to use the image files for print-on-demand items for resale, you must create your own artwork using the original image files under Creative Commons or Derivative Works licensing, as explained at copyright.gov.

But is it in the Public Domain?

Thousands of works published in the United States before 1964 fell into the public domain because the copyright was not renewed in time under the law in effect then. If a work was first published before 1964, the owner had to file a renewal with the Copyright Office during the 28th year after publication, and timeliness was essential. No renewal meant a loss of copyright, forever.

For more information about copyright laws, see this helpful Tree-view chart on Copyright Law or copyright.gov.

What is Collective Work Copyright?

From Stanford Library:

If the artwork is in the public domain, you are free to copy items without restriction. However, even if the artwork is in the public domain, the complete collection may not be reproduced and sold as a clip art collection because that may infringe the unique manner in which the art is collected (known as a compilation or collective work copyright).
